The claimant’s appeal filed April 28, 1998 in the above named matter is dismissed as the matter is now moot.
On April 22, 1998, the trial Commissioner rendered a decision dismissing the claim in the above named matter. Thereafter, a Motion To Open Dismissal and Approval of Settlement was granted by the trial Commissioner. The Commissioner’s granting of that Motion and Stipulation For Agreement and Award of August 19, 1998 impliedly served to vacate the earlier April 22, 1998 Finding and Dismissal.
Thus, as the underlying decision of the trial Commissioner was, in effect vacated the claimant’s appeal is now moot.
