A meeting of the Workers’ Compensation Commissioners was held on Friday, June 9, 2017 at 9:30 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, June 9, 2017 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present except Commissioners Truglia, Mullins and Mlynarczyk. Also present were Nancy Bonuomo, Madeleine Lemieux, Vincent Flynn, Connie Rue, Terri Miro and Tara Remillard of the Workers’ Compensation Commission.

  1. Introduction of New Commissioners
    1. Chairman Mastropietro welcomed and introduced Robert A. D’Andrea and Brenda D. Jannotta – the Commission’s two newest Commissioners.
  2. WCC Jurisdiction Over Settlements/General Releases
    1. Chairman Mastropietro briefly discussed a pending Compensation Review Board decision concerning whether the Commission has jurisdiction over extraneous documents, such as general releases and settlement agreements, as they pertain to stipulations. The Chairman explained that because a CRB decision is still pending, general discussion at this point is premature, but indicated that once the board issues its decision, it will become necessary to further examine the role of the trial commissioner when additional documents are presented for signature at a stipulation approval hearing.
  3. Client Security Fund
    1. Chairman Mastropietro reminded the Commissioners’ that they should have received their notices for the Client Security Fund for 2017. The due date is June 15, 2017
  4. Compensation Rates – PPD
    1. Commissioner Schoolcraft led the discussion concerning when jurisdictional and PPD voluntary agreements are issued at the same time, V.A.s are being rejected as the date of disability is being used, not the date of injury. Discussion ensued and for voluntary agreements being issued for PPD – the date of injury should be used as per the statute.
  5. Seminar
    1. Chairman Mastropietro reported that the seminar being considered for this fall, is being postponed for now due to budgetary constraints and potential departure of key personnel.
  6. Legislation
    1. Chairman Mastropietro provided an overview of legislation affecting the Commission stemming from the 2017 session. Commissioner Mlynarczyk and Commissioner Senich were each also re-confirmed for another five-year term.
  7. Revisions to Mediation Program
    1. Chairman Mastropietro led discussion pertaining revisions to the Mediation Program. Also, please have your offices provide updates to Tara for tracking purposes.
  8. Second Opinions/One Time Evaluations
    1. Chairman Mastropietro reported that a committee to review this section of the protocols has been formed. Commissioners Dilzer and Salerno will lead this effort. The guidelines as a whole will likely need to be reviewed I the near future. If you are interested in being a part of this committee, please let Connie know.
  9. Length of Time to Schedule First Time Hearings
    1. Chairman Mastropietro reported that the district numbers for scheduling first time hearings are in good shape. As there is no current tracking mechanism for subsequent hearings, please be aware of this and report back if your office is experience delays.
  10. MSA Generated Formal Hearing
    1. Discussion ensued about how these type of hearings are handled by the Commissioners.
  11. Budget
    1. Chairman Mastropietro provided an update about the status of the current budget.
  12. Computer Conversion
    1. Chairman Mastropietro reported that the conversion of our computer system has begun and should take about 14 months to complete.

There being no further business, Commissioner Walker made a motion to adjourn. Commissioner Salerno seconded the motion, which passed unanimously. The meeting was adjourned at 11:00 a.m.
