A meeting of the Workers’ Compensation Commissioners will be held on Friday, December 2, 2016 at 9:30 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, December 2, 2016 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present except Commissioners Walker. Also present were Nancy Bonuomo, Madeleine Lemieux, Terri Miro, Connie Rue and Tara Remillard of the Workers’ Compensation Commission.

  1. One-Time Evaluations/Second Opinions
    1. Chairman Mastropietro provided background for the Commissioners. Discussion ensued. It was decided that a committee will be formed to discuss: (1) scrap completely; (2) scrap/replace with new designation; (3) keep it is with two designations but revise language. Commissioners are to report their interest in serving on this committee to Tara as soon as possible.
  2. Commissioners’ Examinations
    1. Chairman Mastropietro lead discussion on this topic. (a) Looking for feedback to prevent the system being maniuplated by doctors for next opening in 2019 or not being willing fo perform the examination at all. (b) Some doctors routinely request more than $750 per exam. Consider options if continualy ask for additonal fees. (c) A lot of doctors receive subsequent reports. One packet of meds should be sent to the doctors. The parties should not be submitting additional reports on their own.
  3. Stipulations with broad respondent and blanket language
    1. Discussion ensued about language submitted in stipulations i.e. “you cannot be employed by any entity owned by this employer.” Paralegal workshop will be held and this will be one of the topics for discussion with them to review the language that may be inappropriate.
  4. Out of State doctors
    1. Chairman Mastropietro reported that he had gotten numerous calls within the last few weeks from out of state doctors that they are charging for reports. Brining to your attention that we have no jurisdiction over them and asking for treatment can harm the claimant’s progress in the case. Claimant needs to understand that the doctor can charge pursuant to the fee schedule and any balances are their responsibility.
  5. Approved dates for CBA/CTLA Seminars
    1. Chairman Mastropietro provided a listing of dates approved for CBA and CTLA seminars that are coming up - there will be no hearings on these dates.
  6. April 28 CBA Seminar
    1. Chairman Mastropietro reported that there is a CBA Seminar on April 28 concerning ethics. The committee is requesting that we provide any issues, questions or fact patterns please feel free to contact Bud Drapeau directly.
  7. Budget
    1. Chairman Mastropietro provided an update as to the current budget.
  8. New Business
    1. Chairman Mastropietro reported that the districts are doing very well as far as scheduling first time hearings. Commission average is under 28 days.

There being no further business, Commissioner Goldberg made a motion to adjourn. Commissioner Salerno seconded the motion, which passed unanimously. The meeting was adjourned at 11:08 a.m.
