Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, September 9, 2016 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present except Commissioners Goldberg and Cohen. Also present were Nancy Bonuomo, Madeleine Lemieux, Terri Miro and Tara Remillard of the Workers’ Compensation Commission.

  1. Form 30C
    1. Chairman Mastropietro reminds you of the change in the statute pertaining municpal employees and when filing a Form 30C, that they must file it with the Town Clerk of the municpality in which they work. The Form 30C has been changed to reflect that change (with language similar to state employees filing their 30C with DAS).
  2. One Time Evaluation/Second Opinion
    1. Chairman Mastropietro provided background as to how this topic arose. Discussion ensued pertaining to what changes, if any, to be made to the WCC Guidelines for Cooperation. It was decided to table discussion until the next meeting. In the interim, please forward suggestions to Tara.
  3. Commissioner Examinations
    1. Chairman Mastropietro reported that he is hearing that these examinations are becoming more and more difficult to schedule for numerous reasons (1) the claimant cannot get into the doctor timely; (2) the doctor’s office will not perform the examination; (3) counsel for the parties are sometimes the issue. The Chairman, when he is ordering Commissioner Examinations, provides three options for scheduling with doctors in the hopes that the claimant will get into one of them sooner rather than later.
  4. NOSS
    1. Chairman Mastropietro provided copies of information that NOSS utilizes in scheduling Commissioners’ Examinations. Discussion ensued. The Commission will be providing NOSS with suggestions on how to improve one of the forms provided.
  5. Computer Conversion
    1. Chairman Mastropietro reported that the Commission is in the midst of searching for a second vendor to proceed with this project. The Chairman also provided background as to how the Commission got to this point.
  6. Findings
    1. Chairman Mastropietro reported at the District Administrator/Management Team meeting earlier this week, the District Administrators were asked to talk with the person in their offices who finalizes the Findings (in most offices it is the Court Reporter). This has become an issue as the parties cited in the caption have been incorrect as the TPA has been listed and the finding is not against them. The NOA form may need to be revised and our IT department contacted about the ability to have the TPA status listed in our system.
  7. Practice Book Update
    1. Chief Law Clerk Nancy Bonuomo provided an update as to changes in the Practice Book and how it applies to the Commission.
  8. Stipulation Language
    1. Chairman Mastropietro reminds the Commissioners that the party responsible for paying the Claimant is not to off load responsibility to third party annuities. This was prompted by an insurance company who contacted the Commission about half the Commissioners accept the language in the stipulation and the other half don’t.
  9. Medicare Set-Asides Update
    1. Commissioner Barton provided a report to the Commissioners about the committee’s discussions.
  10. Teeth PPD
    1. Commissioner Barton lead discussion pertaining to the appropriateness of one week of benefits provided under § 31-308a.
  11. Form 36
    1. Discussion ensued pertaining to a situation Commissioner Engel encountered recently. A Form 36 had been submitted to her district and had been contested. The contest was not because of the rating or the work status - it was because the Form 36 had not been submitted for six months by the adjustor. Procedurally, the Form 36 cannot be approved prior to the receipt of the Form.
  12. Old v. New Hospital Fee Disputes
    1. Four Commissioners have agreed to be experts in the area of the Official Connecticut Fee Schedule for Hospitals and Ambulatory Surgical Centers. (Commissioners Mlynarczyk, Morelli, Schoolcraft and Walker). Any disputes prior to the commencement of the Fee Schedule are being mediated either before Chairman Mastropietro or other outside mediators. Any disputes commencing after the Fee Schedule should be heard before you in your respective offices at the informal level. Should further action be necessary (pre-formals or formals), these files should be transferred to Middletown (for pre-formals before Commissioners Mlynarczyk and Schoolcraft); for formals, they will be heard before Commissioners Morelli and Walker.
  13. Meeting Schedule 2017
    1. The Commissioners were polled as to their preference of frequency of Commissioners’ Meetings for next year (2017). The Commissioners decided to meet four times a year.
  14. Zika Virus
    1. Discussion ensued as to how the Zika Virus may become relevant in the area of workers’ compensation claims.
  15. Dr. Lingham/YNHHS Network
    1. The Chairman reported that Dr. Lingham is no longer in the Yale New Haven Health Services’ Network.
  16. Workers’ Compensation Commission Seminars
    1. Discussion ensued about the upcoming Seminars for medical office staff on September 13 (Hartford) and September 27 (Bridgeport) as well as the payor seminar on October 18 (Hartford).
  17. Budget
    1. Chairman Mastropietro provided an update about the status of the current budget and outlook for the 2016-17 budget.
  18. District Coverage
    1. The Chairman reported that there may be some District Office Coverage issues in the near future. One of our Commissioners will be going out for surgery on October 20 and expects to be out several weeks. The Chairman also reported that there may be additional retirements coming up in the next year as well.

There being no further business, Commissioner Walker made a motion to adjourn. Commissioner Schoolcraft seconded the motion, which passed unanimously. The meeting was adjourned at 12:15 p.m.
