A meeting of the Workers’ Compensation Commissioners was held on Friday, June 3, 2016 at 9:30 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, June 3, 2016 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present except Commissioners Mullins and Truglia. Also present were Nancy Bonuomo, Madeleine Lemieux, Terri Miro, Connie Rue and Tara Remillard of the Workers’ Compensation Commission and Angelo Sevarino, Esq.

  1. Facility Fee Schedule
    1. Chairman Mastropietro introduced Terri Miro from our Middletown office who will be replacing Marilou Lang when she retires at the end of July. Terri has been shadowing Marilou and the transition should be as smooth as possible. This fee schedule was implemented a little over a year ago. There are some items still being ironed out. As this area is somewhat complicated, the Chairman was looking for Commissioners who may want to be better educated in the area to work with Marilou and Terri before Marilou retires in case any of these cases goes to a formal. Commissioners Mlynarczyk, Schoolcraft, Morelli and Walker expressed interest in becoming versed with the Fee Schedule.
  2. Issue involving medications
    1. Chairman Mastropietro reported that several members of the Medical Advisory Panel have been reviewing a report and will report back at the next meeting as to their recommendations about utilizing DNA Swab Testing as a way to determine if claimants would have adverse reactions to mixing of medications.
    2. The legislature has passed a bill (HB 5053) which prohibits physicians from prescribing opiates for more than a seven day supply. This will be incorporated into the Commission’s protocols.
  3. Role of APRNs
    1. The Chairman reported that in the latest session, the legislature elevated the role of APRNs. Discussion ensued as how this would potentially conflict with the Commission’s present rules. It was agreed to seek input from the Medical Advisory Panel. It was also agreed that a Form 36 may be signed by the APRN only and the Commission would accept the APRN’s opinion as to work capacity.
  4. Amtrust/Hospital Settlement Conference
    1. Chairman Mastropietro reported that Amtrust and numerous hospitals in the State have reached an agreement to settle approximately 262 more cases. A settlement conference has been scheduled. Magna Carta is the next to be scheduled.
  5. Lumbermen’s
    1. Chairman Mastropietro reported that Lumbermen’s has been declared insolvent by the State of Missouri’s Bankruptcy Court. The Connecticut Insurance Guaranty Association (CIGA) is gathering information to determine the number of files transferring to their organization. Matters are stayed by the Bankruptcy Court. CIGA is continuing benefits for 10 weeks for those currently receiving benefits. If there are any cases that have an immediate need for medical attention (i.e. surgery), please contact the Chairman’s office and CIGA will be contacted.
  6. Seminars
    1. Chairman Mastropietro reported that a number of years ago, medical offices and insurers/payors were educated about the guidelines and medical protocols enacted by the Commission. It has been determined that an update is due. The sessions are as follows: medical office staff seminar (September 13 in Hartford or September 27 in Bridgeport) and the insurer seminar (October 18 in Hartford).
  7. Client Security Fund
    1. Chairman Mastropietro reminded the Commissioners that they should have received the notice about this and it is due June 17, 2016.
  8. Mediation Program
    1. Chairman Mastropietro inquired of the Commissioners their feedback concerning this program started July 1, 2015. If the program needs to be adjusted, please send your feedback to the Chairman’s attention. Discussion ensued as to cancellation policy and claimant’s attendance at the session. Once suggestions are received, the criteria for requesting mediations will be revised and circulated for feedback prior to general distribution.
  9. Legislative Update
    1. Chairman Mastropietro provided an update about bills passed during the 2016 Legislative Session.
  10. Budget
    1. Chairman Mastropietro provided an update about the status of the current budget and outlook for the 2016-17 budget.
  11. Supreme Court/Florida Decision
    1. The Chairman notified the Commissioners that a decision rendered by the Supreme Court of Florida capping attorneys fees for claimants in that state has been deemed unconstitutional. It appears as if the statute in Florida is significantly different from Connecticut policy and therefore is unlikely to have any impact here.

There being no further business, Commissioner Walker made a motion to adjourn. Commissioner Mlynarczyk seconded the motion, which passed unanimously. The meeting was adjourned at 11:18 a.m.
