A meeting of the Workers’ Compensation Commissioners will be held on Friday, December 4, 2015 at 9:30 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, December 4, 2015 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present except Commissioners Mullins and Walker. Also present were Nancy Bonuomo, Madeleine Lemieux, Vincent Flynn, Marilou Lang, Connie Rue and Tara Remillard of the Workers’ Compensation Commission and Angelo Sevarino, Esq.

  1. Guest Speaker
    1. Angelo Sevarino, Esq. spoke to the Commissioners about the Medicare Set-Aside provisions - particularly about hearings on the merits as defined by CMS.
  2. Commissioners’ Workshop
    1. Chairman Mastropietro wants to schedule a Commissioners’ Workshop. Commissioners are to provide dates that they may be away on vacation to Tara so that a firm date can be established.
  3. ASCs
    1. The Chairman reported on discussions from a recent meeting concerning the implementation of the Hospital Fee Schedule. Discussion ensued as to whether there were any issues with the timeliness of surgeries being scheduled at Ambulatory Surgical Centers. The Commissioners will monitor.
  4. Security/Weapons
    1. Discussion ensued concerning the possible alteration of the Agency’s policy regarding weapons at our offices. Draft language will be formulated concerning same.
  5. 120 Days Rule
    1. Chairman Mastropietro reminds Commissioners of the 120 Days Rule in issuance of their decisions. If the parties request an extension, that request may be granted at the Commissioners’ discretion.
  6. Update from Legal and Medical Advisory Panels Meetings
    1. The Chairman provided an update from recent Legal and Medical Advisory Panel Meetings.
  7. Mediation Dockets
    1. Discussion ensued about how the process is going and if any changes are needed for same. It was decided that the physical file will not be transferred to the district where the mediation hearing is being held. A meeting will be scheduled with the District Administrators to develop further procedures.
  8. Correspondence from Patrick P. Mastroianni, MD
    1. Chairman Mastropietro provided correspondence from Dr. Mastroianni that he is available to perform Commissioners’ Examinations and Respondent Medical Examinations upon request.
  9. NOA Form
    1. Discussion ensued about a change to the Notice of Appearance Form providing a space for Third Party Administrators. It was decided that this change would be made when it fits into the Agency’s present computer upgrade schedule.
  10. Liberty Mutual/Eversource
    1. Discussion ensued whether the Commissioners have experienced any complaints about Liberty Mutual as the new TPA for Eversource. Should a problem arise, the Chairman’s office should be notified so the issue can be resolved. Liberty Mutual is working to alleviate any transition problems.
  11. Budget
    1. Chairman Mastropietro indicated there was no update at this time as a special session of the Legislature to address the budget had been called for next week.
  12. New Business
    1. Discussion ensured about the Utilization Review process and the regulatory time table associated with same. Discussion also ensued about AIG closing in-house counsel offices effective January 29, 2016. The Commission will monitor the situation to avoid disruptions in cases.

There being no further business, Commissioner Delaney made a motion to adjourn. Commissioner Mlynarczyk seconded the motion, which passed unanimously. The meeting was adjourned at 11:43 a.m.
