Minutes

A regular meeting of the Workers’ Compensation Commission Advisory Board was held on September 12, 2016 in the Workers’ Compensation Commission’s CRB Hearing Room, 21 Oak Street, Hartford, Connecticut. The meeting convened at 10:00 a.m. with the following present: Chairman Michael Riley; members Rocco Calo, Michael Dimenstein, and Gregory Nokes. Also present from the Workers’ Compensation Commission were Chairman John Mastropietro, Michael Petosa, Virginia Alling, Fred Massa and Tara Remillard.

    1. Chairman Michael Riley welcomed the group.
  2. Chairman Mastropietro’s Update
    1. State Auditors Report Issued July 2016
      Fred Massa, WCC Manager of Information Technology, explained the State Auditors’ findings and the circumstances surrounding the agency’s contract for the workers’ compensation claims conversion project. Discussion was held.
    2. Budget Update from the 2016 Special Session
      Chairman Mastropietro recapped the agency’s current budget and staffing situation, along with the impending impact of the Governor’s recent announcement of requiring 10% budget reduction from each agency for Fiscal Year 2018.
    3. Legislation Passed in 2016 Special Session
      Chairman Mastropietro provided a recap of the legislation passed during the 2016 legislative session.
      1. Public Act No. 16-39 (Senate Bill No. 67) — An Act Concerning the Authority and Responsibilities of Advanced Practice Registered Nurses:
        This legislation significantly elevates the status of APRNs in the state and it will have an impact on the workers’ compensation system. Examples: APRNs will now be able to sign Form 36s and determine work capacity. The Commission will be assessing other changes related to this new law. Effective October 1, 2016.
      2. Public Act No. 16-73 (Senate Bill No. 101) — An Act Concerning Workers’ Compensation Insurance and Sole Proprietors:
        This legislation enables sole proprietors who do not carry workers’ compensation insurance to work on public works projects with certain requirements. Effective October 1, 2016.
      3. Public Act No. 16-43 (House Bill No. 5053) — An Act Concerning Opioids and Access to Overdose Reversal Drugs:
        This legislation will revise the opiate prescribing process. The Commission implemented the new restrictions into its Opioid Protocols. Effective July 1, 2016 and various dates.
      4. Public Act No. 16-10 (House Bill No. 5262) — An Act Establishing a Firefighters Cancer Relief Program:
        This legislation provides wage replacement benefits (in lieu of coverage under the Workers’ Compensation Act) to fire personnel affected by certain cancer conditions. Effective February 1, 2017.
      5. Public Act No. 16-112 (House Bill No. 5364) — An Act Concerning the Filing of Workers’ Compensation Claims When a Municipality is the Employer:
        This legislation requires a municipal employee to provide a copy of the notice of claim directly to the town clerk’s office where he/she is employed. Effective July 1, 2016.
    4. Upcoming WCC Seminars
      1. The Commission will present three educational training seminars in 2016. Medical issues will be covered at the September 13 and September 27 events and payor issues at the October 18 seminar. Registration is required. Interested parties may contact the Chairman’s Office for further information.
    5. 2017 WCC Commissioner Renominations
      1. Materials were distributed to the Board members to review for the next meeting. Terms for Commissioners Charles Senich, Peter Mlynarczyk, and Jack Goldberg will end in 2017.
    6. WCC Advisory Board Vacancy
      1. Discussion was held on the Advisory Board vacancy of a person representing employees which has existed since September 1, 2014.
  3. Adjournment
    1. Michael Dimenstein made a motion to adjourn the meeting. Rocco Calo seconded the motion which passed unanimously. The meeting was adjourned at 11:05 a.m.

    1. The next meeting will be held on October 17, 2016.
