Respondent filed a Petition for Review May 9, 2016 from a Discretionary Order issued April 27, 2016 by the trial commissioner acting for the Fourth District. No record exists as the order was issued as the result of an informal hearing. Due process requires an evidentiary hearing where a record can be created. The Compensation Review Board cannot properly consider this appeal under Sec. 31-301(a).

The matter is therefore remanded for a Formal Hearing or other appropriate action. See, Alley v. Performance Landex, LLC, 6094 CRB-7-16-5 (May 12, 2016), Tomlinson v. State/Department of Developmental Services – North Region, 6020 CRB-8-15-6 (July 15, 2015).
