The claimant filed an appeal on September 11, 2014 from the trial commissioner’s September 2, 2014 communication addressing the claimant’s Memoranda Re: Legal Authority For Deposition dated August 29, 2014. No transcript or exhibits exist. Due process requires an evidentiary hearing where a record can be created. Absent a record the Compensation Review Board cannot properly consider an appeal under Sec. 31-301.

This matter is therefore remanded to the trial commissioner acting for the Eighth District for a Formal hearing or other appropriate action. See Smith v. Amerbelle Corporation, 5375 CRB-1-08-9 (September 16, 2008); Naveo v. R.H.I. Corp., 5066 CRB-4-06-3 (April 18, 2006).
