Purdy v. Bank of New Canaan

CASE NO. 5540 CRB-7-10-4

COMPENSATION REVIEW BOARD

WORKERS’ COMPENSATION COMMISSION

APRIL 26, 2010

LESLEY PURDY

CLAIMANT-APPELLANT

v.

BANK OF NEW CANAAN

EMPLOYER

and

CRAWFORD & COMPANY

INSURER

RESPONDENTS-APPELLEES

ORDER

Claimant filed a Petition for Review April 9, 2010 as the result of a ruling on motions issued by the trial commissioner on December 14, 2009 and a subsequent April 5, 2010 letter to the parties of record by the trial commissioner.

Until there is a written decision from a Formal hearing creating a record, wherein transcripts and exhibits exist, the appeal is premature.

In addition, at the present time there is no final judgment.

The appeal is therefore remanded to the trial commissioner acting for the Seventh District. See Bryant v. Pitney Bowes, Inc., 5455 CRB-7-09-4 (May 8, 2009), DiBlase v. Logistec of Connecticut, Inc., 5305 CRB-3-07-11 (January 3, 2008).
