Respondents filed a Petition for Review December 28, 2009 from the trial commissioner’s December 10, 2009 Order. Said order was issued absent a hearing creating a record. Absent a record this board cannot properly consider an appeal under Sec. 31-301(a). The matter is therefore remanded to the trial commissioner acting for the Sixth District for a Formal Hearing or other appropriate action. See Archer v. Goodwill Industries, 5498 CRB-1-09-9 (October 14, 2009).
