Pursuant to the decision of the Appellate Court, Healey v. Hawkeye Construction, LLC, 124 Conn. App. 215 (2010), the February 26, 2009 Opinion of the Compensation Review Board is vacated. In accordance with the directive of the Appellate Court, the April 1, 2008 Finding & Dismissal of the trial commissioner is reversed. The appeal is remanded to the trial commissioner acting for the Second District for further proceedings.
