WORKERS’ COMPENSATION COMMISSION

MARCH 3, 2004

MARK DeMATTEO

CLAIMANT-APPELLEE

v.

TOWN OF EAST HAVEN

EMPLOYER

and

WEBSTER INSURANCE

INSURER

RESPONDENTS-APPELLANTS

ORDER

Respondents filed a Petition for Review from the trial commissioner’s January 21, 2004 Sec. 31-308a Order. That order was issued as a result of an informal hearing. No transcript or exhibits exist. Thus, there is no record for this board to properly consider this appeal under Sec. 31-301. The appeal is therefore remanded to the trial commissioner acting for the Third District for a formal hearing or other appropriate action. See Threlfall v. Connecticut Institute For The Blind, 4727 CRB-6-03-9 (October 8, 2003); Pantanella v. Enfield Ford, 4721 CRB-1-03-9 (September 18, 2003); Carmody v. Waterbury, 4712 CRB-5-03-8 (September 16, 2003); Mack v. State/Department of Correction, 4589 CRB-1-02-11 (January 8, 2003); Fiamma v. Moliterno Stone Sales, 4465 CRB-1-01-12 (December 20, 2001).
