Pantanella v. Enfield Ford

CASE NO. 4720 CRB-1-03-9

CASE NO. 4721 CRB-1-03-9

COMPENSATION REVIEW BOARD

WORKERS’ COMPENSATION COMMISSION

SEPTEMBER 18, 2003

DANIEL PANTANELLA

CLAIMANT-APPELLEE

v.

ENFIELD FORD

EMPLOYER

and

TIG INSURANCE CO., et al

INSURER

RESPONDENTS-APPELLANTS

ORDER

Respondents filed a Petition for Review September 12, 2003 from the trial commissioner’s August 25, 2003 Orders; one pursuant to Sec. 31-308a and the second pursuant to Secs. 31-288 and 31-300 for failure to appear at an informal hearing. As those orders were issued as a result of an informal hearing, no transcript or exhibits exit. Thus, there is no record for this board to properly consider these appeals under Sec. 31-301. The matter is therefore remanded to the Sixth District for a formal hearing or other appropriate action. See, Mace v. Tradesource, Inc., 4664 CRB-6-03-5 (May 14, 2003); Mele v. City of Hartford, 4453 CRB-1-01-9 (November 30, 2001); Rizor v. International Ice Cream Corp., 4206 CRB-1-00-3 (May 24, 2000).
