Carmody v. City of Waterbury

CASE NO. 4712 CRB-5-03-8

COMPENSATION REVIEW BOARD

WORKERS’ COMPENSATION COMMISSION

SEPTEMBER 16, 2003

JOHN CARMODY

CLAIMANT-APPELLEE

v.

CITY OF WATERBURY

EMPLOYER

and

BERKLEY ADMINISTRATORS

INSURER

RESPONDENTS-APPELLANTS

ORDER

Respondent, City of Waterbury, filed a Petition for Review from the trial commissioner acting for the Fifth District’s August 7, 2003 Order pursuant to Sec. 31-308a. That order was issued as a result of an informal hearing. No transcript or exhibits exist. Thus, there is no record for this board to properly consider this appeal under Sec. 31-301. The matter is therefore remanded to the Fifth District for a formal hearing or other appropriate action. See, Mace v. Tradesource, Inc., 4664 CRB-6-03-5 (May 14, 2003); Mack v. State/Department of Correction, 4589 CRB-1-02-11 (January 8, 2003); Fiamma v. Moliterno Stone Sales, 4465 CRB-1-01-12 (December 20, 2001); Lirot v. Mashantucket Pequot Gaming, 3400 CRB-2-96-8 (April 7, 1997).
