JULY 9, 2003
JULIO ORTIZ
CLAIMANT-APPELLEE
v.
MOSEY’S, INC.
EMPLOYER
and
AIG CLAIMS SERVICES
INSURER
RESPONDENTS-APPELLANTS
Respondents filed a Petition for Review May 5, 2003 from the trial commissioner’s April 28, 2003 ruling on Motion For On Site Inspection. The ruling was issued without a formal hearing on the record. No transcript or exhibits exist. Thus, there is no record for this board to properly consider this appeal pursuant to Sec. 31-301. The matter is therefore remanded to the First District for a formal hearing or other appropriate action. See Mace v. Tradesource, Inc., 4664 CRB-6-03-5 (May 14, 2003); Mack v. State/Department of Correction, 4589 CRB-1-02-11 (January 8, 2003); McKim v. C & S Wholesale Grocers, Inc., 4565 CRB-1-02-9 (October 10, 2002); Gomes v. Bridgeport, 4510 CRB-4-02-3 (April 25, 2002); Fiamma v. Moliterno Stone Sales, 4465 CRB-1-01-12 (December 20, 2001).
