This Motion to Withdraw Appearance, regarding the Petition for Review from the September 30, 1997 Finding and Dismissal of the Commissioner acting for the Sixth District, was heard January 23, 1998 before a Compensation Review Board Panel consisting of the Chairman Jesse M. Frankl and Commissioners Michael S. Miles and Stephen B. Delaney.

RULING ON MOTION TO WITHDRAW AS CLAIMANT’S COUNSEL

JESSE M. FRANKL, CHAIRMAN. The claimant’s attorney has filed a Motion to Withdraw as counsel for the claimant in the above captioned appeal. The claimant’s attorney indicated that he had filed the Petition for Review solely to preserve the claimant’s right to appeal, and that he had never indicated to the claimant that he would represent the claimant in said appeal. The claimant does not object to the Motion to Withdraw. Pursuant to a bench ruling, the Compensation Review Board unanimously granted the motion.

The Motion to Withdraw as claimant’s counsel is granted.

Commissioners Michael S. Miles and Stephen B. Delaney concur.
