CASE NO. 3491 CRB-4-96-12
COMPENSATION REVIEW BOARD
WORKERS’ COMPENSATION COMMISSION
DECEMBER 24, 1996
BRENDA LATHROPE
CLAIMANT-APPELLANT
v.
TELEDYNE PENN UNION
EMPLOYER
and
CNA INSURANCE
RESPONDENTS-APPELLEES
The claimant-appellant’s Motion For Permission To Extend Appeal, Motion To Correct, and Motion To Submit Additional Evidence Time Period filed dated November 27, 1996 and filed December 2, 1996 is denied insofar as the Motion seeks to extend the time for the filing of an appeal from the Finding and Dismissal dated November 8, 1996. The time for the period by which an appeal must be filed with the Compensation Review Board is a matter controlled by Sec. 31-301(a). Pursuant to Sec. 31-301(a) an appeal must be filed within ten days of the entry of the award.
In this case even if we were to construe the above noted motion as an appeal petition, the motion was filed after the period for filing an appeal expired. Furthermore, the Compensation Review Board lacks the authority to extend the period for filing an appeal beyond the period provided by statute. Therefore, insofar as the claimant’s Motion seeks to extend the time for filing an appeal, it is denied. If claimant seeks to file a Motion To Submit Additional Evidence, she may do so. See Administrative Regulation Sec. 31-301-9.
Jesse M. Frankl, Chairman
