This Petition for Review from the April 21, 1995 Finding and Dismissal of the Commissioner acting for the Third District was heard March 15, 1996 before a Compensation Review Board panel consisting of the Commission Chairman Jesse M. Frankl and Commissioners Michael S. Miles and Robin L. Wilson.
JESSE M. FRANKL, CHAIRMAN. The claimant filed a timely appeal on May 1, 1995 from the April 21, 1995 Finding and Dismissal of the Commissioner acting for the Third District. The respondents filed a Motion to Dismiss the claimant’s appeal based upon the claimant’s failure to prosecute her appeal with due diligence.
On March 15, 1996, this board issued a bench ruling denying the respondents’ motion to dismiss. See Molbury v. Midwest Drivers Corporation, 10 Conn. Workers’ Comp. Rev. Op. 202, 1278 CRD-7-91-8 (Nov. 12, 1992) The merits of the claimant’s appeal will be scheduled to be heard by the Compensation Review Board.
