A meeting of the Workers’ Compensation Commissioners was held on Friday, June 6, 2014 at 9:30 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, June 6, 2014 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present except Commissioner Delaney, Commissioner Morelli and Commissioner Mlynarczyk. Also present were Marvin Smernoff, Nancy Bonuomo, Madeleine Lemieux, Vincent Flynn, Connie Rue and Tara Remillard of the Workers’ Compensation Commission.

  1. Liberty Mutual
    1. Discussion ensued about issues concerning Liberty Mutual’s administration of cases before the Commission. In many instances in the last few months, the Chairman noted that the person attending a hearing on their are not able to obtain the necessary authority to resolve the issues involved. It was decided that if problems continue, Formal Hearings will be scheduled immediately to address all issues.
  2. MSA Language in Stipulations
    1. Discussion ensued concerning Liberty Mutual’s use of MSA language in stipulations. Correspondence from Liberty Mutual was distributed to the Commissioners. Commissioner Engel and Chairman Mastropietro also shared recent MSA Language utilized by other insurers. The Commissioners were also provided copies of CMS’ “Self-Administration Toolkit for Workers’ Compensation Medicare Set-Aside Arrangements (WCMSAs)”. A Commissioner Workshop will be scheduled to explore this topic further.
  3. Legislation and SB 61
    1. The Chairman reported that the Agency fared well during this past Legislative Session. A wait and see approach will be followed as how the APRN and Hospital Acquisition legislation will affect the Commission. SB 61 has a more immediate impact on the Commission. The Commission is to develop a Medicare based fee schedule by January 1, 2015 to reimburse hospitals for workers’ compensation services. A Committee with various stakeholders has been created and any Commissioners interested in participating should let Marilou Lang know.
  4. Deposition of Adjusters
    1. Discussion ensued regarding correspondence received from Attorney Neil Ambrose. Any objections to subpoenas being issued should be brought to the Commissioners attention. A response will be drafted to Attorney Ambrose and disseminated to the Commissioners.
  5. Appointment of Doctors by Commissioners as Treating Physicians
    1. Chairman Mastropietro advised that certain physicians have requested advance notice of a commissioner’s designation of them as treating physicians. The Commissioners agreed that advance notice is appropriate and will comply.
  6. Communications by Attorneys
    1. Discussion ensued regarding the section B on page 14 of the WCC Guidelines for Cooperation. It was decided that clarification may be needed.
  7. § 31-308a
    1. Information was provided to the Commissioners. Tabled to the next meeting so the Commissioners can review the packet they received at today’s meeting.
  8. Client Security Fund
    1. Chairman Mastropietro reminds the Commissioners that they should have received their invoices and they should remit their payments as soon as possible to ensure the Agency’s compliance.
  9. CRB
    1. Chairman Mastropietro indicates that a Fall session of the Compensation Review Board will be held as a CLE opportunity for the Workers’ Compensation Section of the Bar Association. This session is tentatively scheduled to be held at the Legislative Office Building.
  10. Compound Drugs
    1. Chairman Mastropietro asks that you keep this topic in mind as it is becoming more prelevant than in the past. This is situation where drugs are tailored to an individual usually resulting in significantly higher costs. If it is determined that it is becoming a problem, we may need to consider adjustments to our guidelines/protocols.
  11. Narcotics Task Force
    1. An update from the Medical Advisory Panel was provided to the Commissioners. A subcommittee has been formed to review polices in place as it pertains to narcotics usage in the workers’ compensation arena. Anyone wishing to participate on the Committee, please contact Marilou Lang.
  12. Budget
    1. The Chairman provided an update pertaining to the budget for this fiscal year.

There being no further business, Commissioner Walker made a motion to adjourn. Commissioner Salerno seconded the motion, which passed unanimously. The meeting was adjourned at 11:51 a.m.
