Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, September 13, 2013 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present. Also present were Marvin Smernoff, Nancy Bonuomo, Madeleine Lemieux, Connie Rue and Tara Remillard of the Workers’ Compensation Commission.

  1. 2013 Commissioner Meeting Schedule
    1. The Commissioners were polled as to the frequency of the Commissioners’ Meeting for next year (2014). The Commissioners decided to meet four times a year.
  2. 100th Anniversary
    1. The Chairman reported on the Committee’s progress in planning the Symposium, scheduled for October 3, 2013. A goal of the Committee is to raise monies for the Disabled Workers Scholarship Fund (hoping to donate around $45,000). The Chairman thanked Jean Bonzani, Nancy Bonuomo, Connie Rue, Lawrence Morizio, David Weil, Robert Kehmna and Diane Duhamel for their respective efforts in this endeavor.
  3. New District Administrators and Middletown District Office
    1. The Chairman announced that the two vacant District Aministrator positions have been filled. Mary Ellen Norton has begun as the District Administrator in Middletown. Brenda Henowitz (formerly of the Norwich District Office) will begin as the New Britain District Administrator at the beginning of October. The Chairman also reported that the Agency is able to fill vacant positions in Middletown, Stamford and Waterbury (two positions). The Chairman also reported that we are working in conjuction with Public Works of DAS to move the Middletown office into a new location as quickly as possible. A number of sites will be visited in the near future.
  4. Thomas Dubrosky v. Boehringer Ingelheim (AC 35030)
    1. Discussion ensued pertaining to the decision rendered in this case as it relates to preclusion. It was decided to take a “wait and see” approach to see the long term effects of this decision.
  5. Hospital Reimbursement
    1. The Chairman reported that there are currently approximately 1800 cases ready for trial (involving six hospitals). These cases are mostly in the Norwich, New Haven, Bridgeport and Waterbury district offices. Commissioner Schoolcraft issued a decision on a case he heard, which is currently on appeal to the Supreme Court. Discussion ensued around the various avenues where this could lead to (a statutory change).
  6. Budget
    1. The Chairman provided an update pertaining to the budget for this fiscal year.

There being no further business, Commissioner Mlynarczyk made a motion to adjourn. Commissioner Delaney seconded the motion, which passed unanimously. The meeting was adjourned at 11:10 a.m.
