Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, December 7, 2012 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present. Also present were Marvin Smernoff, Nancy Bonuomo, Madeleine Lemieux, Vincent Flynn, and Tara Remillard of the Workers’ Compensation Commission.

  1. CRB Panel 2013
    1. The Compensation Review Board Panel for 2013 is Chairman Mastropietro, Commissioner Peter Mlynarczyk and Commissioner Charles Senich.
  2. Paul Straznicky, MD; Solomon Aordkian, MD; Arpad S. Fejos, MD
    1. The Chairman provided copies of these doctors Curriculum Vitae to the Commissioners as they have expressed interest in providing pain management services or performing independent medical examinations.
  3. Payor Provider Guidelines
    1. The Chairman reviewed the purpose of the Guidelines with the Commissioners. The Chairman reminded the Commissioners that they are an important piece of the process in enforcing the Guidelines. Over the last few months, the Chairman has visited a number of insurance companies and third party administrators reminding them of their role with the Guidelines.
  4. NCCI Executive Summary
    1. The Commissioners were provided with the NCCI Executive Summary from their recent annual meeting. Included in the information is NCCI's request for a 7.1% increase in premiums, partially due to catastrophic incidents (Kleen Energy explosion and the Hartford Distributors shooting). In contrast, the Commission's Assessment has declined over the past few years to 1.84%.
  5. Commissioner Evaluation Surveys
    1. The Commissioner were provided copies of proposed changes to the current evaluation survey. The Commissioners are asked to provide their input to Tara by December 31, 2012.
  6. 100th Anniversary
    1. The Chairman reported that the Symposium Committee has met several times and are still in the early stages of planning the event. The symposium will be held on October 3, 2013 at the Crowne Plaza in Cromwell. The theme is "Yesterday, Today and Tomorrow". Sub-committees are being formed and include: history and curriculum. The Chairman asked that any of the Commissioners with ideas for breakout sessions, et cetera; or if interested in participating on the Committee, to please contact Connie as soon as possible.
  7. Attorney Occupational Tax Return (Department of Revenue Services Form 472)
    1. The Chairman reminded the Commissioners that they should have received the Attorney Occupational Tax Return, and it is due on or before January 15, 2013 to the Department of Revenue Services.
  8. Folios Directory
    1. Discussion ensued about the costs associated with purchasing updated Folios Directories. Costs are different for printed copies ($1,000) as opposed to access through the internet ($400). Several questions arose from this discussion: accessible from the hearing rooms?; ability to print pages?; how many users will there be and will there be someone who knows how to use it? This will be researched prior to a final decision being made.
  9. Commissioner Examination Form
    1. Discussion ensued about the proposed changes that Commissioner Salerno provided regarding the Commissioner Examination Form. The Commissioners decided that they would now use the letter drafted by Commissioner Salerno.
  10. Minor Dependent Children
    1. The Commissioners were provided copies of proposed language from the Minor Dependent Task Force in an effort to process stipulations where minor dependent children are involved and where the Probate Court might have jurisdiction. The Commissioners input and/or comments would be greatly appreciated and should be directed to Maddie Lemieux as soon as possible.
  11. Stipulation
    1. Commissioner Salerno had a proposed stipulation before her recently involving a Medicare Set Aside. The Commissioners decided to table discussion at this time and revisit the issue at the next meeting in order to have the opportunity to review it further.

There being no further business, Commissioner Delaney made a motion to go into Executive Session. Commissioner Vargas seconded the motion, which passed unanimously. The meeting was adjourned at 11:45 a.m.
