A meeting of the Workers’ Compensation Commissioners was held on Friday, December 2, 2011 at 9:30 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commissioners was held on Friday, December 2, 2011 at the office of the Chairman of the Workers’ Compensation Commission, Capitol Place, 21 Oak Street, Hartford, Connecticut. The meeting convened at 9:30 a.m. with all Commissioners present. Also present were Marvin Smernoff, Nancy Bonuomo, Vincent Flynn, Madeleine Lemieux, Connie Rue-Yatcko, David Sims, Sandra Cunningham, Marilou Lang and Tara Remillard of the Workers’ Compensation Commission.

  1. Commissioner Practice Book
    1. Copies were distributed to the Commissioners. Chairman Mastropietro and Commissioner Salerno thanked the Committee Members for their efforts. Special thanks were given to David Sims and Nancy Bonuomo for their time and talent. Chairman Mastropietro reminded the Commissioners that this book is a guide to help streamline the efficiency of the Agency.
  2. Pre-formal Hearings
    1. Discussion ensued about how the Pre-formal Hearing should be utilized. Pre-formal Hearing’s are a great tool to set the guidelines and parameters for the Formal Hearing.
  3. Commissioner’s Examiner
    1. Daniel Nijensohn, MD sent a letter expressing interest in becoming a Commissioner’s Examiner. His Curriculum Vitae was distributed to the Commissioners.
  4. Formal Hearing Transcripts
    1. The Chairman will be meeting with the Court Reporters about the Formal Hearing Transcript process. Any input you may have would be greatly appreciated.
  5. Commissioner Evaluation Update
    1. The Chairman reported that a new category for tracking hearings is being created in an effort to achieve greater accuracy. This category will reflect when a hearing has gone on the record to record a settlement without the need for trial.
  6. CRB Panelists 2012
    1. The panelists for 2012 are Commissioners Dilzer and Gregg.
  7. Minor Dependent Task Force
    1. A task force including Probate Judges Brian Mahon and Charles Norris, Commissioner Truglia, Chairman Mastropietro and various workers’ compensation attorneys was formed and the initial meeting has occurred. Chairman Mastropietro and Commissioner Truglia reported that a joint policy will be developed and shared between the Commissioners and Probate Judges where there is a settlement of a claim worth more than $10,000 where the deceased claimant has minor dependent children.
  8. Chairman’s Update
    1. Doctors dispensing prescriptions - Complaints have been received that doctors have been dispensing prescriptions out of their offices at inflated prices. Research has been conducted regarding costs and what other states have done regarding this issue.
    2. Security - Should the need arise for a State Police Officer to be at a hearing, please contact Connie Rue-Yatcko who will coordinate with the State Police. Ultimately, it is the Commissioner’s decision whether security is needed. Please try to have multiple security hearings on the same day as we are paying for four hours of their time.
    3. Medical Providers - We have received several referrals regarding medical providers who charge excessive fees, do not provide reports, etc. We will intervene where necessary when provided specific information.
    4. Budget - The Chairman provided a status as to where the Agency currently stands financially and the positions we are able to fill.
    5. UConn - Should you experience any difficulties receiving reports from UConn, please provide specifics to the Chairman.
    6. Length of time to schedule First Hearing - Information was distributed to the Commissioners. The Districts are doing a good job about conducting hearings within the 28 day time frame.
    7. Medical Advisory Panel - The next meeting is on January 24, 2012 at 6 pm at 21 Oak Street, First Floor Cafeteria.

There being no further business, Commissioner Delaney made a motion to adjourn to Executive Session. Commissioner Vargas seconded the motion, which passed unanimously. The meeting was adjourned to Executive Session at 11:30 a.m.
