Minutes

A regular meeting of the Workers’ Compensation Commission Advisory Board was held on October 19, 2015 in the Workers’ Compensation Commission’s CRB Hearing Room, 21 Oak Street, Hartford, Connecticut. The meeting convened at 10:15 a.m. with the following Board Members present: John Adamson, Rocco Calo, Michael Dimenstein, Theodore Duarte, Ross Hollander, and Gregory Nokes. Also present from the Workers’ Compensation Commission were Chairman John A. Mastropietro, Michael Petosa, Vincent Flynn and Connie Rue; along with Louise DiCocco from the CBIA.

  2. Chairman Mastropietro’s Update
    1. Legislation Passed in 2015 Special Session
      1. Chairman Mastropietro discussed the two agency-related provisions passed in the Budget Implementer during the June 2015 Special Session as Public Act No. 15-5.
      1. Section 52 requires an employer to provide their list of approved providers to an injured worker within 48 hours of notification of a work-related injury. Several concerns exist on the bill: (1) what constitutes “notification” is not defined; (2) what method an employer may choose to comply, i.e., paper, Internet, or electronic manner is not defined; and (3) no penalties for non-compliance are enumerated.
      2. Section 468 ultimately interferes with the Commission’s ability to settle outstanding hospital cases. Some believe the new language purports to reestablish the law as it existed prior to the Carabello decision, and added a one year statute of limitations. The language that has been reinstated is the language that the Connecticut Supreme Court determined was unworkable. Chairman Mastropietro explained that any effort to rely on this language will undoubtedly lead to a challenge as to its constitutionality.
    2. Budget Update from 2015 Special Session
      1. Chairman Mastropietro discussed the impact of the Governor’s recent FY 2017 budget reduction to the Commission of $1.16 million. He explained the agency’s plan to convert its outdated computer system to a web-based system that would be compatible with the majority of state agencies and the industry as a whole; and would allow for the upgrades needed for electronic filing, etc. Unfortunately, the reduced funding may stall the completion of the program.
    3. WCC Commissioner Renominations
      1. Discussion was held concerning the renominations of Commissioners Mastropietro and Barton. The Judiciary Committee informed the Commission that it will be necessary for the Commissioners to go through the renomination process again during the 2016 legislative session. Chairman Mastropietro announced that there will also be a new Commissioner vacancy effective January 31, 2016.
    4. WCC Advisory Board Chairman Vacancy
      1. The group discussed identifying a replacement for the position of Chairperson of the Advisory Board, which has been vacant since December 8, 2014. Suggestions included retired workers’ compensation commissioners and persons who have served the Commission over past years. Rocco Calo moved to request the Chairman’s assistance in identifying persons who may be willing to lead the board. Ross Hollander seconded the motion, which passed unanimously.
    5. WCC Advisory Board Vacancy
      1. The group also discussed the vacancy for a representative of “employees”, required by statute, which is vacant. Rocco Calo moved to request the Chairman’s assistance in alerting the Governor’s Office. Michael Dimenstein seconded the motion, which passed unanimously.
  3. Approval of Meeting Dates for 2016
    1. A motion to approve the meeting dates for 2016 was made by John Adamson. Gregory Nokes seconded the motion, which passed unanimously. 2016 meeting dates will be February 8, March 7, April 4, May 9, June 6, September 12, October 17, and November 7.
  4. Approval of Minutes
    1. A motion to approve the minutes for April and May of 2015 was made by Ross Hollander and seconded by John Adamson. The motion passed unanimously.
  5. Adjournment
    1. John Adamson made a motion to adjourn the meeting. Rocco Calo seconded the motion which passed unanimously. The meeting was adjourned at 11:20 a.m.
  6. Next Meeting
    1. The next meeting will be held on November 16, 2015.
