A meeting of the Workers’ Compensation Advisory Board was held on Monday, June 10, 2013 at 10:00 a.m. at the Office of the Chairman, 21 Oak Street, 4th Floor, Hartford, CT.

Minutes

A regular meeting of the Workers’ Compensation Commission Advisory Board was held on June 10, 2013 in the Workers’ Compensation Commission’s CRB Hearing Room, 21 Oak Street, Hartford, Connecticut.

The meeting convened at 10:05 a.m. with the following Board Members present: Acting Chairman Rocco Calo, presiding; John Adamson, Michael Dimenstein, Ted Duarte, Ross Hollander, and Gregory Nokes. Chairman John Mastropietro, Marvin Smernoff and Michael Petosa of the Workers’ Compensation Commission were also in attendance.

  2. Chairman Mastropietro’s Update
    1. Legislation:
    2. Chairman Mastropietro discussed the final action affecting the Workers’ Compensation Commission taken by the 2013 Legislature:
      1. i. The following proposed bills did not pass:
        1. Senate Bill No. 823 - An Act Concerning Severe Mental or Emotional Impairment and Workers’ Compensation Coverage.
        2. Senate Bill. No. 907 - An Act Concerning Additional Requirements for an Employer’s Notice to Dispute Certain Care Deemed Reasonable for an employee under the Workers’ Compensation Act.
        3. Senate Bill No. 1074 - An Act Concerning Workers’ Compensation and Liability for Hospital Services.
      2. ii. Budget. In addition to its requested appropriation, the agency received $3 M for FY 14 and FY 15 to begin developing an electronic claim filing system. The agency anticipates accomplishing technology upgrades to the WCS System and electronic filing of claims and other forms over the next seven years.
      3. iii. The Middletown District Office will remain open.
      4. iv. Hospital Docket. The agency anticipates establishing a hospital docket to handle the large influx of claims which result from recent District formal hearing decisions and the failure of passage Senate Bill 1074. Currently, 1,310 claims have been filed disputing the definition of “actual costs” and billed charges rendered by hospitals. A dedicated hospital docket will be necessary to properly manage the claims while the Appellate Court determines its next action. Chairman Mastropietro stated that it will be very difficult for the agency to maintain the current 21-day waiting time for first hearings as it proceeds to deal with these complicated cases.
  3. 100th Anniversary
    1. Chairman Mastropietro advised that the Symposium committee is in the final stages of developing the October 3, 2013 program of panels and speakers. Approximately one-half of the monies necessary to fund the event have been raised. All net funds will be donated to the Disabled Workers’ Scholarship Fund. The committee is still looking for vendors for the event. Suggestions are welcome.
  4. Approval of Minutes
    1. A motion was made by Ted Duarte and seconded by John Adamson to approve the Board’s minutes for meetings held on April 8, 2013. A motion was made by Ross Hollander and seconded by John Adamson to approve the Board’s minutes for meetings held on April 8, 2013. Both motions received unanimous approval.
  5. Adjournment
    1. A motion to adjourn the meeting was made by Greg Nokes and seconded by John Adamson. The Motion passed unanimously. The meeting was adjourned at 11:15 a.m.
    2. The next regular meeting will be held on September 9, 2013.
