Minutes

A regular meeting of the Workers’ Compensation Commission Advisory Board was held on June 25, 2012 in the Workers’ Compensation Commission’s CRB Hearing Room, 21 Oak Street, Hartford, Connecticut.

The meeting convened at 10:05 a.m. with the following Board Members present: Chairman Gardner Wright, Rocco Calo, Daniel Krause, Gregory Nokes, and Linda Passanisi. Also present from the Workers’ Compensation Commission were Chairman John Mastropietro and Marvin Smernoff.

    1. Chairman Gardner Wright welcomed the group.
  2. Chairman Mastropietro’s Update
    1. Official Practitioners Fee Schedule
      1. Chairman Mastropietro announced the 2012 WCC “Official Practitioners Fee Schedule” will be released on July 15, 2012. The new fee schedule will address the cost of physician-dispensed repackaged prescriptions by defining average wholesale price (AWP). Effective July 15, 2012, the amount a physician will be reimbursed for dispensing pharmaceuticals in his/her office will be limited to the AWP plus $5 for brand and $8 for generic as has always been the case for pharmacies. This new policy will not prevent doctors from dispensing pharmaceuticals at their offices, but it will curb the additional costs associated with office dispensing.
    2. WCRI Report on Prescription Dispensing by Physicians
      1. Chairman Mastropietro also reported that the Workers’ Compensation Research Institute (WCRI) recently released a study of 25 states with data gathered for years between 2007 and 2010 specifically designed to measure the impact of doctors dispensing prescription drugs in their offices. In 2007, 18% of all prescriptions issued to injured workers were dispensed through doctor’s offices representing 16% of the total cost of prescriptions. In 2010, costs increased with 28% of all prescriptions issued to injured workers representing 37% of the total cost of prescriptions.
    3. Hospitals - “Actual Cost” White Paper
      1. Chairman Mastropietro advised the Board that the white paper discussing hospitals and “actual cost” will be finalized and distributed to the members within the next few weeks. The hospital white paper is being developed to resolve the problem of defining the term “actual cost” under C.G.S. Sec. 31-294d(d) which regulates the employers’ liabilities for hospital services. Following the Board’s review, the final proposal will be presented to Lt. Gov. Nancy Wyman for consideration.
    4. New Commissioner
      1. Chairman Mastropietro announced that Governor Malloy has nominated Stephen M. Morelli of Berlin, CT, as a workers’ compensation commissioner to fill the vacancy of Clifton Thompson who unexpectedly passed away on May 18, 2012. Attorney Morelli is scheduled to appear before the Judiciary Committee on July 10, 2012.
    5. Information Technology Vacancy
      1. Chairman Mastropietro distributed a memo describing the agency’s efforts to establish and fill a new position in the IT department to replace the two consultants who recently left the agency. The Human Resources Director is currently advertising to fill the new ITA3 position.
    6. Adjournment
      1. A motion to adjourn the meeting was made by Rocco Calo and seconded by Greg Nokes. The motion passed unanimously. The meeting adjourned at 11:00 a.m.
    7. Next Meeting
      1. The next regular meeting will be held on September 12, 2012.
